Terms of Service

These Terms of Service (the “Terms”) are an agreement between you and Throwawish (“Throwawish,” “we,” “us,” or “our”). They govern your access to and use of throwawish.com and the wishing-well features, content, and services offered through it (collectively, the “Service”). By accessing the Service, submitting a wish, or completing a purchase, you agree to these Terms and our Privacy Notice. If you do not agree, do not use the Service or buy a wish.

The $1 purchase, in plain language

You are buying a one-time placement of a wish in a shared digital well—not permanent placement. After successful payment, your wish is added to the visible well. The well has limited capacity (currently 24 paid wishes), so newer paid wishes cover and replace the oldest visible positions. Once enough newer wishes arrive, your wish will leave the visible well. There is no guaranteed display period. A public wish may remain available in other public parts of the Service after its coin leaves the visible well. A private wish is publicly represented only by a generic “Private wish” coin and its date and time.

1. Eligibility

You must be at least 13 to use the Service. If you are under the age of legal majority where you live, you may use it only with permission and supervision from a parent or legal guardian who agrees to these Terms. You must be legally able to enter this agreement and authorized to use the payment method you provide. The Service is not directed to children under 13.

2. Wishes, visibility, and privacy

You choose whether a wish is public or private. If you choose public, the wish text may be read, copied, captured, or reshared by anyone. “Anonymous” does not mean that identification is impossible, so do not include names, contact details, addresses, account credentials, health information, financial information, or other sensitive or identifying information.

If you choose private, we do not intentionally display the wish text to the public. The visible well may show a generic “Private wish” coin and its date and time. We and our service providers still process and store the submitted text as described in the Privacy Notice. No online service can promise absolute confidentiality or security.

Leaving the visible well does not necessarily delete a wish. Public wishes may continue to appear in public feeds, and both public and private wishes may remain in operational records, backups, fraud-prevention records, or records we must retain by law.

3. Your content and the permission you give us

You retain any ownership rights you have in the text you submit. You are solely responsible for it and represent that you have the rights needed to submit it and that doing so does not violate another person’s rights or any law.

You give us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, filter, moderate, and otherwise use your wish only as reasonably needed to operate, secure, maintain, and improve the Service. If you choose public, this license also lets us display and distribute the wish through the public parts of the Service. The license lasts while the wish is retained, including for a reasonable backup period and as needed for legal, safety, and fraud-prevention purposes. We do not claim ownership of your wish.

4. Content and conduct rules

Do not use the Service—including private-wish mode—to submit, promote, request, or facilitate:

This list is not exhaustive. Do not use the Service in a way that harms people, interferes with others’ use, exposes us or others to legal or safety risk, or defeats the purpose of a shared wishing well.

5. Moderation and enforcement

We may use automated filters and human review, but we do not promise to review every wish or catch every violation. We may reject, hide, restrict, edit for formatting or safety, make non-public, preserve, or permanently remove any wish; limit or block access; refuse a transaction; or take other reasonable action at any time if we believe content violates these Terms, creates risk, or harms the Service or other people. We may report or disclose content and related information when reasonably necessary to comply with law, respond to valid legal process, protect someone from harm, prevent fraud, or protect our rights.

Moderation is imperfect and may produce false positives or fail to identify objectionable material. User wishes are created by users, are not verified, and do not represent our views. We do not endorse their accuracy, advice, promises, or opinions.

6. Purchases, placement, and refunds

The price and currency shown at checkout apply to your purchase. By paying, you authorize our payment processor to charge the selected payment method. The digital placement service begins immediately after a successful payment. A purchase does not buy a permanent archive, minimum viewing time, priority, promotion, ownership interest, physical item, charitable contribution, wager, or any promise that a wish will come true.

Except where the law requires otherwise, a successfully placed wish is final and non-refundable. Removal or restriction for violating these Terms does not entitle you to a refund. If payment succeeds but a technical failure prevents us from placing the wish, contact us promptly so we can retry the placement or provide an appropriate remedy. We may cancel and refund a transaction at our discretion. Payments are processed by Stripe and may also be subject to Stripe’s terms and privacy notice.

7. Entertainment only; no outcomes or professional advice

Throwawish is a digital entertainment and personal-reflection experience. We do not promise that wishes will be granted or that using the Service will produce any real-world result. The Service is not medical, mental-health, crisis, legal, financial, religious, or other professional advice and is not a substitute for qualified help. If you or someone else may be in immediate danger, contact local emergency services or an appropriate crisis service.

8. Our Service and intellectual property

The Service—including its software, artwork, animation, design, branding, and operator-created text—is owned by us or our licensors and protected by intellectual-property laws. We give you a limited, personal, revocable, non-transferable right to use the Service for its intended purpose while you follow these Terms. No other rights are granted.

9. Third-party services and links

The Service relies on third parties for functions such as payment processing, hosting, security, and, if enabled, advertising. It may also link to third-party sites. We do not control and are not responsible for third-party services, content, availability, security, or practices. Your use of them may be governed by their own terms and policies.

10. Availability, changes, and ending the Service

We may change the well’s capacity, presentation, price for future purchases, features, moderation methods, or other parts of the Service. We may suspend or discontinue some or all of the Service, temporarily or permanently. We do not promise uninterrupted access, error-free operation, preservation of any wish, or advance notice of every change or outage. We may update these Terms by posting a revised version and changing the date above. Material changes apply prospectively to the extent required by law.

11. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We disclaim all express and implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, security, accuracy, and uninterrupted availability. You use the Service and rely on any user content at your own risk.

12. Limitation of liability

To the fullest extent permitted by law, Throwawish and its operator, contributors, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, opportunities, reputation, or emotional distress, arising from or related to the Service, a wish, user content, a purchase, temporary placement, moderation, a security event, or a third-party service.

To the fullest extent permitted by law, our total liability for all claims related to the Service will not exceed the greater of (a) the amount you paid to Throwawish in the 12 months before the event giving rise to the claim or (b) US $100. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, willful misconduct, or any non-waivable consumer right. Some jurisdictions do not allow certain exclusions, so some of this section may not apply to you.

13. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Throwawish, its operator, contributors, contractors, and service providers from third-party claims, liabilities, damages, losses, and reasonable costs arising from your wish, your misuse of the Service, your violation of these Terms or law, or your violation of another person’s rights. This obligation does not apply to the extent a claim was caused by our own unlawful conduct.

14. Reports, copyright concerns, and contact

To report a wish, claim that content infringes your rights, report a purchase problem, or ask about these Terms, email legal@throwawish.com. Include enough information to locate the wish (such as its text and approximate date), explain the issue, and contact you. For an intellectual-property report, also identify the protected work or right, explain why the use is unauthorized, and confirm that your report is accurate and made in good faith. If there is an immediate threat, contact local emergency services first.

15. General terms

These Terms and the Privacy Notice are the entire agreement between you and us about the Service and replace prior discussions about it. If any provision is found unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. You may not transfer your rights or obligations under these Terms without our consent; we may transfer ours as part of a reorganization, financing, sale, or transfer of the Service. Sections that by their nature should survive—including content licenses, payment terms, disclaimers, liability limits, and indemnity—survive termination. These Terms do not limit any mandatory rights you have under applicable law.
